Békhudi Meditation Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Békhudi Meditation website, online courses, programmes and services provided by Békhudi Meditation, operated by Tehmina Mansoor (“Békhudi”, “we”, “us” or “our”).

By accessing our website, creating an account, purchasing a course or service, or otherwise using our Services, you agree to be bound by these Terms. Please read them carefully before making a purchase or using our Services.

If you do not agree to these Terms, please do not use our website or purchase or access our Services.

1. About Békhudi

Békhudi Meditation is a spiritual and contemplative education platform offering meditation, Sufi-inspired practices, courses, workshops and related services.

Békhudi operates as a sole proprietorship under the name Tehmina Mansoor.

Our Services currently include, among other things:

  • The Békhudi Journey online courses, including Levels 1, 2 and 3; and
  • Transform & Thrive, a one-to-one service provided directly by Tehmina Mansoor.

We may introduce, modify or discontinue Services from time to time.

2. Acceptance of These Terms

By using our website or Services, you confirm that:

  • you have read and understood these Terms;
  • you agree to comply with these Terms and applicable laws;
  • the information you provide to us is accurate and complete; and
  • where you make a purchase, you are authorised to use the payment method used for that purchase.

If you are purchasing a Service on behalf of another person, you are responsible for ensuring that they are made aware of these Terms.

3. Website Accounts

Certain Services require you to create an account on our website.

When creating an account, you may be asked to provide information including your name, email address and password.

You are responsible for:

  • providing accurate and current information;
  • keeping your account information up to date;
  • maintaining the confidentiality of your password;
  • keeping your account secure; and
  • all activity carried out through your account.

Your account is personal to you. You may not share your login details or allow another person to access paid course content through your account.

4. The Békhudi Journey – Online Courses

The Békhudi Journey currently consists of three online levels:

  • Level 1
  • Level 2
  • Level 3

Each course provides access to digital educational and contemplative material made available through the Békhudi website and learning platform.

The specific content, structure and materials included in each course will be described on the relevant course page at the time of purchase.

Lifetime Access

Unless otherwise stated on the relevant course page at the time of purchase, a purchased Békhudi online course includes lifetime access to the course materials through the Békhudi learning platform.

“Lifetime access” means access for the duration that Békhudi continues to operate and make the relevant course available through its platform. It does not mean that Békhudi guarantees that the website, platform or a particular course will remain available indefinitely or without modification.

We may update, revise, replace or improve course content from time to time.

We will make reasonable efforts to preserve access to courses that have already been purchased. If circumstances require us to permanently discontinue a purchased course or substantially alter the way it is delivered, we will endeavour to provide reasonable notice where practicable.

5. One-to-One Services – Transform & Thrive

Transform & Thrive is a one-to-one service provided directly by Tehmina Mansoor.

The nature, format, duration, schedule and fees for Transform & Thrive will be communicated separately to the individual participant.

Transform & Thrive is not purchased through the online course checkout process unless expressly stated otherwise.

Payment for Transform & Thrive is currently made by bank transfer according to the payment arrangements communicated to the participant.

6. Payments

All course prices and applicable fees will be displayed or communicated before purchase.

At present, payments for online courses are made by bank transfer according to the payment instructions provided by Békhudi.

A course enrolment will generally be confirmed once the required payment has been received and verified by Békhudi.

You are responsible for ensuring that the correct payment amount is transferred and that any bank charges or transfer fees applicable to your payment are covered where relevant.

Békhudi reserves the right to change course prices or fees for future purchases. Any price change will not affect a purchase that has already been completed and confirmed.

7. Refunds and Cancellations

Unless otherwise required by applicable law, payments for Békhudi online courses are non-refundable.

Because our online courses provide access to digital educational content, purchases are considered final once payment has been received and access to the course has been granted.

We do not offer refunds because a participant:

  • changes their mind after purchasing;
  • decides that the course is not suitable for them;
  • does not complete the course;
  • does not use their course access; or
  • is unable to continue with the course after purchase.

Nothing in these Terms is intended to exclude or restrict any rights or remedies that cannot lawfully be excluded or restricted under applicable consumer protection law.

In exceptional circumstances, Békhudi may, at its discretion, consider a refund or other resolution. Any such decision does not create an obligation to provide refunds in similar circumstances in the future.

8. Course Access and Personal Use

Your purchase gives you a personal, limited, non-exclusive and non-transferable right to access and use the course materials for your own personal education and practice.

You may not:

  • share your account or login credentials;
  • allow another person to access a course purchased by you;
  • copy, reproduce, record, download, distribute or commercially exploit course materials except where expressly permitted;
  • upload Békhudi course materials to another website, platform, social media account or file-sharing service;
  • sell, sublicense, transfer or otherwise provide access to course materials to another person;
  • reproduce Békhudi’s course structure, teachings or materials for your own commercial course, workshop or programme without our written permission; or
  • use Békhudi course materials to provide training or instruction to others without our written permission.

Unauthorised sharing or distribution of course materials may result in suspension or termination of your access without refund, in addition to any other rights or remedies available to Békhudi.

9. Intellectual Property

All content made available through Békhudi, including but not limited to:

  • course videos;
  • audio recordings;
  • written materials;
  • worksheets;
  • meditations;
  • exercises;
  • course structures;
  • text;
  • graphics;
  • photographs;
  • logos;
  • branding; and
  • other original materials

is owned by or licensed to Békhudi and/or Tehmina Mansoor and is protected by applicable intellectual property laws.

Your purchase of a course or Service does not transfer ownership of any intellectual property to you.

You may use the materials solely for the personal purposes for which they are provided.

No part of Békhudi’s intellectual property may be reproduced, republished, distributed, modified, sold or commercially exploited without prior written permission.

10. Your Content and Testimonials

If you voluntarily provide Békhudi with feedback, testimonials, photographs or other content for publication or promotional purposes, you confirm that you have the right to provide that material to us.

Where you provide a testimonial or other content for Békhudi to publish, you grant Békhudi permission to use that content for purposes connected with Békhudi’s work, including on our website and social media channels, subject to any specific agreement or permission given at the time.

We will not knowingly use your photograph, name or testimonial for promotional purposes where you have specifically asked us not to do so.

If you wish to withdraw permission for a testimonial or similar content that you have provided to Békhudi, please contact us at [email protected]. We will consider such requests reasonably and, where practicable, remove the material from future use.

11. Meditation and Wellbeing Disclaimer

Békhudi’s Services are intended for education, contemplation, meditation, spiritual development and personal practice.

They are not medical, psychological, psychiatric or other professional healthcare services and should not be treated as a substitute for professional medical or mental-health advice, diagnosis or treatment.

Békhudi does not make any guarantee that participation in its courses, meditation practices or other Services will produce a particular physical, psychological, emotional, spiritual or other outcome.

You are responsible for deciding whether a particular practice is appropriate for you and for seeking advice from an appropriately qualified healthcare professional where necessary.

If you have a medical or mental-health condition, are receiving treatment, are pregnant, or have any other concern about participating in meditation, breathing, movement or other practices, you should consult an appropriately qualified professional before participating.

You should stop any practice that causes you significant discomfort, distress or concern and seek appropriate professional assistance where necessary.

12. No Guarantee of Results

Békhudi’s teachings and practices are intended to support personal exploration and development.

Individual experiences and outcomes vary. We do not guarantee any particular result, transformation, spiritual experience, emotional outcome or other benefit from using our Services.

Testimonials or statements shared by Békhudi participants represent individual experiences and should not be understood as a guarantee that another person will experience the same results.

13. Acceptable Use

You agree to use our website and Services lawfully and respectfully.

You must not:

  • use our website for unlawful purposes;
  • attempt to gain unauthorised access to our website, accounts or systems;
  • interfere with the operation or security of our website;
  • introduce malicious software or harmful code;
  • impersonate another person;
  • use another person’s account without permission;
  • copy or misuse our intellectual property;
  • use our Services to harass, threaten or harm another person; or
  • engage in any activity that could damage Békhudi, its community or its reputation.

We reserve the right to suspend or terminate access where we reasonably believe these Terms have been violated.

14. Website and Third-Party Services

Our website may contain links to or content provided by third parties.

For example, our website may contain embedded content from YouTube or use third-party technologies such as Google Fonts.

Third-party websites and services are governed by their own terms and privacy policies. Békhudi is not responsible for the content, availability, security or privacy practices of third-party websites or services.

We may also update, replace or remove third-party services used by our website from time to time.

15. Website Availability

We aim to keep the Békhudi website and learning platform available and functioning properly, but we cannot guarantee uninterrupted or error-free access.

The website or particular Services may occasionally be unavailable because of:

  • maintenance;
  • technical issues;
  • updates;
  • hosting or platform problems;
  • internet or network failures;
  • circumstances outside our reasonable control; or
  • other operational reasons.

We will make reasonable efforts to restore access when reasonably practicable.

16. Changes to Our Services

Békhudi is continually developing its offerings.

We may add, modify, update, suspend or discontinue aspects of our website or Services from time to time.

For courses that have already been purchased, we will make reasonable efforts not to materially reduce the core value of the purchased course without good reason.

Nothing in these Terms prevents us from making reasonable changes to improve, update or maintain our Services.

17. Suspension or Termination of Access

We may suspend or terminate your access to our website, account or paid Services if:

  • you materially breach these Terms;
  • you share or distribute paid course content without permission;
  • you misuse your account;
  • you engage in unlawful or abusive conduct; or
  • continued access creates a security, legal or operational risk for Békhudi.

Where access is terminated because of a serious or deliberate breach of these Terms, you may not be entitled to a refund.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Békhudi and Tehmina Mansoor will not be responsible for indirect, incidental, consequential or special losses arising from your use of the website or Services.

We are not responsible for losses arising from circumstances outside our reasonable control, including technical failures, internet disruptions, third-party platform failures or unauthorised access resulting from circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims or reasonable costs incurred by Békhudi as a result of your material breach of these Terms, misuse of the Services, unlawful conduct or infringement of another person’s rights.

This provision does not apply to the extent that the relevant loss was caused by Békhudi’s own unlawful conduct or negligence.

20. Privacy

Your use of our website and Services is also governed by our Privacy Policy, which explains how we collect, use, store and protect personal information.

Our Privacy Policy forms part of these Terms.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements.

When we update the Terms, we will post the revised version on our website and update the Effective Date.

Your continued use of the website or Services after updated Terms have been posted constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles.

Subject to any mandatory consumer protection rights or other applicable law, disputes arising in connection with these Terms or the Services shall be subject to the jurisdiction of the courts of Pakistan.

Nothing in this section prevents a consumer from exercising any mandatory rights available to them under the laws applicable to their circumstances.

23. Entire Agreement

These Terms, together with our Privacy Policy and any other policies expressly incorporated into them, constitute the agreement between you and Békhudi regarding your use of our website and Services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it later.

This is neat - alumni from AKU-ISMC have set up an Urdu-English meditation platform to help people cope with the crisis of uncertainty and lockdown. We make a big deal about training future leaders in AKU-ISMC and sometimes that means people who have obvious positions of authority, like politicians, diplomats, scholars or entrepreneurs, but sometimes it means taking a lead in more personal capacities to try and make things better for others.

I'm truly impressed and humbled by Tehmina Mansoor and Zohaib Zuby. They are definitely demonstrating the kind of leadership that makes me proud to be part of AKU.
